Not many businesses hope they won’t see their clients again in a hurry!  We hope our clients are fortunate enough not to be involved in accidents which result in injury, but unfortunately no-one can predict when an accident is going to happen.  see you again soonWhen it does and when the injury causes disruption to the personal and home life of the victim then many clients feel it is appropriate to make a claim for damages to compensate for the injury they have sustained and for any financial losses resulting from the accident.

If you have been in an accident the last thing you want is to worry about legal costs and being left with a bill for the costs of pursuing a claim; or even worse the costs of the other party! 

Like most things it’s all about discussion.  Discussing the risks and options in a way that you the client can understand rather than in nonsense legal jargon generally leads to a better relationship between solicitor and client.  Better for you the client.  Better for us, your Solicitors. 

At Handley Brown the aim of our personal injury team is to provide a one to one service for our clients to help and advise if they have been unfortunate enough to be injured following an accident.  Most people have heard of No Win No Fee but what does it really mean? 

Under a 'no win, no fee' agreement your solicitor will only be paid if your claim is successful.  If your claim fails your Solicitor will not be paid for the work they have done on your case.  To reflect the risks of losing some cases your Solicitor is entitled to charge a ‘success fee’ if the case is successful.  The success fee is calculated as a percentage of your Solicitors basic charges and both the basic fee and this extra fee are normally paid in whole or part by the losing party. 

If your case fails you will not have to pay your own solicitor, but you will still probably have to pay the costs of your opponent.  You will also have to pay any disbursements incurred during the case, such as medical report fees or court fees.  Your solicitor will normally be able to arrange insurance to cover this risk and make arrangements for you to obtain an 'after the event' insurance policy which will pay your opponents costs and the disbursements.
